This paper was presented at the Second World Congress on Logic and Religion on the sub-topic of logics vis-à-vis illogicalities in religion. It deals with fourteenth-century-logician Thomas Manlevelt’s Ockhamist approach to logic (the ars vetus, strictly speaking) and its ontological outcome: rejection of the existence of substance. Although God, the Trinity, the Blessed Virgin, the Antichrist and the consecrated host keep popping up within the domain of logic, it is argued that Manlevelt kept clear water between logic and theology. Things (...) divine, and especially the transubstantiation of the consecrated host, do however play a crucial role in the development of his idea of the non-existence of substance. It is suggested that this might imply the miraculous nature of the whole universe. (shrink)

Artists have appropriated cooking as an aesthetic practice - in turn, cooks are adapting the staging practices that go with an artistic self-image. This development is accompanied by a philosophy of cooking as a speculative cultural technique. Exploration of Alfred North Whitehead's influence on Maurice Merleau-Ponty's ontology of nature.

State legitimacy is often said to have two aspects: an internal and an external one. Internally, a legitimate state has the right to rule over its subjects. Externally, it has a right that outsiders not interfere with its domestic governance. But what is the relation between these two aspects? In this paper, I defend a conception of legitimacy according to which these two aspects are related in an importantly asymmetrical manner. In particular, a legitimate state’s external right to rule affords (...) it protections that include and go beyond what its internal right to rule enables it to do. This asymmetrical view, I argue, is preferable to its two main rivals: the view that a state’s internal and external legitimacy are separate issues, and the view that internal and external legitimacy are mirroring. The idea that law claims authority (LCA) has recently been forcefully criticized by a number of authors. These authors present a new and intriguing objection, arguing that law cannot be said to claim authority if such a claim is not justified. That is, these authors argue that the view that law does not have authority viciously conflicts with the view that law claims authority. I will call this the normative critique of LCA. In this article, I assess the normative critique (...) of LCA, focusing predominantly on the arguments presented by its most incisive proponent Philip Soper. I defend a twofold conclusion. First, LCA, understood roughly along the lines put forward by Joseph Raz, is part of the most attractive analysis of law. Second, proponents of the normative critique, and in particular Soper, are committed to accepting LCA. (shrink)

This article aims to provide some insight into the nature and content of the theory of associative political obligation. It does this by first locating the view in the wider debate on political obligation, analyzing the view in terms of four central elements that are shared by many of its versions, and then discussing important criticisms that have been made of each of these, as well as some rejoinders by defenders of the theory.

In this broad historical and critical overview based on a lifetime of scholarship, James Alfred Martin, Jr., examines the development of the concepts of beauty and holiness as employed in theories of aesthetics and of religion. The injunction in the Book of Psalms to "worship the Lord in the beauty of holiness" addressed a tradition that has comprehended holiness primarily in terms of ethical righteousness--a conception that has strongly influenced Western understandings of religion. As the author points out, however, (...) the Greek forbears of Western thought, as well as many Eastern traditions, were and are more broadly concerned with the pursuit of beauty, truth, and goodness as ideals of human excellence, that is, with the "holiness of beauty." In this work Martin describes a philosophical stance that should prove to be most productive for the dialogue between aesthetics and religion. Beginning with the treatment of beauty and holiness in Hebrew, Greek, and classical Christian thought, the author traces the emergence of modern theories of aesthetics and religion in the Enlightenment. He then outlines the role of aesthetics in the theories of religion proposed by Otto, Eliade, van der Leeuw, and Tillich, in the cultural anthropology of Geertz, and in the thought of Santayana, Dewey, Whitehead, Heidegger, and Wittgenstein. In a global context Martin explores the relation of aesthetic theory to religious thought in the traditions of India, China, and Japan and concludes with reflections on the viability of modern aesthetic and religious theory in the light of contemporary cultural and methodological pluralism. Legal and moral reasoning share much methodology, and they address similar problems. This volume charts two shared problems: the relation between theory, principles and particular judgments; and the role of facts and factual assertions in normative settings. The relation between 'theory' and 'practice' and between 'principle' and 'particular judgment' has become the subject of much debate in moral philosophy. In the ongoing debate, some moral philosophers refer to legal philosophy for a support of their views on the primacy of 'practice' (...) over 'theory'. According to them, legal philosophy should have a more balanced view in that relation. In the contributions to Part One this claim is critically analysed. The role of the facts is underestimated in discussions on legal reasoning and legal theory, as well as moral reasoning and ethical theory. Factual statements enter into moral and legal discussions not only because they link the conclusion with a rule. They also play a role as background assumptions in supporting a theory. Its focus on the role of facts in normative reasoning makes this book of special interest to scholars of legal and moral argumentation. (shrink)

In the present work we illustrate how two sorts of defeasible reasoning that are fundamental in the normative domain, that is, reasoning about exceptions and reasoning about violations, can be simulated via monotonic propositional theories based on a bimodal language with primitive operators representing knowledge and obligation. The proposed theoretical framework paves the way to using native theorem provers for multimodal logic, such as MleanCoP, in order to automate normative reasoning.

Many researchers studying subjective wellbeing (SWB) understand SWB as a concept that is close to Bentham’s notion of happiness. This conception of happiness is philosophically controversial, because it treats pleasure as a homogenous experience. I analyze an important deviation from Bentham in John Stuart Mill’s Utilitarianism and its relevance for SWB research: qualitative differences in pleasurable experiences. I argue that in cases where lives involving qualitatively different experiences are compared, Mill’s qualitative perspective is incompatible with an important assumption in the (...) SWB literature: that happiness can be meaningfully rated by people on a scale. I illustrate the problem by means of the question of whether becoming a parent makes people happier. I analyze whether the problem can be avoided on alternative views of happiness, but argue that on all plausible accounts of happiness, the problem persists. I conclude that the problem it poses for self-reported happiness is genuine and should be acknowledged by SWB researchers. I end by discussing the ways in which this conclusion can help the study of happiness move forward. (shrink)

This article presents the results of a qualitative study on the ethical aspects of inclusion practice for radiotherapy patients taking part in clinical research. The study focused on the standards and values of this process. Patients and physicians were interviewed about their views and experiences. Analysis of these interviews showed that candidate research participants need better protection from unwanted factors that could influence their choice about participation. Researchers need proper education about regulation, codes and directives in the field of research (...) ethics, and they should be aware of the underlying ethical concepts of these regulations. A sound institutional ethics policy is necessary in order to guide medical staff in decisions about the inclusion of patients in trials. (shrink)

Due to its extraordinary predictive power and the great generality of its mathematical structure, quantum theory is able, at least in principle, to describe all the microscopic and macroscopic properties of the physical world, from the subatomic to the cosmological level. Nevertheless, ever since the Copen hagen and Gottingen schools in 1927 gave it the definitive formu lation, now commonly known as the orthodox interpretation, the theory has suffered from very serious logical and epistemologi cal problems. These shortcomings were immediately (...) pointed out by some of the principal founders themselves of quantum theory, to wit, Planck, Einstein, Ehrenfest, Schrodinger, and de Broglie, and by the philosopher Karl Popper, who assumed a position of radical criticism with regard to the standard formulation of the theory. Certain organoid subtypes are particularly sensitive. We explore whether moral intuitions about the heartbeat warrant unique moral consideration for newly advanced contracting cardiac organoids. Despite the heartbeat’s moral significance in organ procurement and abortion discussions, we argue that this significance should not translate into moral implications for cardiac organoids.

From 1991 to 1994 the Dutch Health Insurance Council financed research on Extracorporeal Membrane Oxygenation (ECMO). This is a technique for providing cardiopulmonary bypass to patients with pulmonary and/or cardiac failure. Most often, these patients are premature neonates. During ECMO, blood is drained from the right atrium, pumped along a membrane where gas exchange takes place, and then redirected to the aorta. To prevent blood clotting, heparin is added. However, with the heparin added, the risk of hemorrhage is considerably increased. (...)
